General IR35 guidance

What are the new rules to consider when hiring or undertaking a Contract and who is responsible for enforcing them?

New IR35 rules
  • If the contractor provides services to a small client outside of the public sector, you (the contractors intermediary) will continue to be responsible for deciding the contractor’s employment status.
  • If the contractor provides services to a small client outside of the public sector, you (the contractors intermediary) will continue to be responsible for deciding the contractor’s employment status.
  • All public sector clients and medium or large-sized clients outside the public sector are responsible for deciding a contractors employment status.
  • The responsibility for assessing IR35 tax status is now the responsibility of the hiring organisation.
